1. Scope

• The Nita Mukesh Ambani Junior School (“School”) operates and maintains the sub-domain https://onlineadmission.nmajs.edu.in, https://edusprint.nmajs.edu.in and related pages of the website https://nmajs.edu.in/ (“Portal”).

• The Portal is a platform for users to access information, tools and management services of the School, including but not limited to educational content, educational resources, information about management, admissions, academics, events and other such information, as provided on the Portal from time to time (collectively known as “Services”).
• Your use of the Portal is subject to these Terms and Conditions (“Terms”) and on the basis that you agree to these Terms and the privacy policy of the Portal.
• By registering or signing up to the Portal, or otherwise having access to, receiving information from, and/or using the Portal, you acknowledge having read and understood, and consent to be governed and bound by these Terms and the privacy policy of the Portal. If you do not understand these Terms or the privacy policy of the Portal, or do not accept any part of them, then you should not use the Portal.
• The Terms are an electronic record in terms of the Information Technology Act, 2000 (as amended / re-enacted) and rules thereunder, and is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates the publishing of rules and regulations, privacy policy and terms of use for access or usage of the Portal. This electronic record is generated by a computer system and does not require any physical or digital signatures.

• Modifications of the Terms: The School reserves the right to change the Terms under which the Services are offered, including but not limited to the charges, if any, associated with the use of the Services. The Terms may also be modified by the School from time to time basis changes in business, legal and regulatory requirements, and will be updated online. The School will make reasonable efforts to communicate any significant changes to these Terms to you; however, your continuous usage of the Portal shall be deemed as acceptance of the then-current Terms. You are encouraged to periodically visit this page to review these Terms and any changes to it. You agree that your continued use of the Services constitutes an acknowledgment that you have read, understood, and agree to be bound by the Terms and Conditions so amended.
• Modification of Services: The School reserves the right to add, modify or delete any content or features available as part of the Services at any time at its sole discretion and with no liability to you.

4. Links to third party sites and Applications

• The Portal may contain links to other websites / applications ("Linked Sites"). The Linked Sites are not under the control of the School and the School is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site or any information transmitted by a Linked Site. The inclusion of any link does not imply endorsement by the School of the Linked Site or any association with its operator(s).
• Any dealings with third parties (including advertisers) included within or available via a link from the Portal or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. In accessing Linked Sites, you agree and acknowledge that you do so solely at your own risk and expense, and that the School shall not be responsible or liable for any such dealings or promotions.
• You acknowledge and agree that the use of any Linked Site is governed by such third party’s terms of use, license agreement, privacy policy, and / or any other agreement specified in such Linked Site.
• THE SCHOOL HEREBY DISCLAIMS ALL RESPONSIBILITY FOR ANY DISCLOSURE OF INFORMATION BY OR OTHER PRACTICES OF ANY THIRD PARTY. THE SCHOOL EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY WITH RESPECT TO YOUR PERSONAL OR OTHER INFORMATION THAT MAY BE COLLECTED, PROCESSED, SHARED OR RETAINED BY ANY THIRD PARTY.

• “Content" means all audio/ visual works, including all interactive content, texts, photographs and stickers, made available to you through the Portal. The Content is owned by the School or licensed to the School by third party content providers. Subject to your strict and full compliance with the Terms, the School hereby grants you a personal, limited, non-exclusive, non-transferable and revocable license to use the Content for your private and personal use through your device.
• You represent and warrant that all information uploaded by you shall either be owned by you or you will have valid authorization and license to upload the same and such information shall not violate any of these Terms. You represent and warrant that during the period that you access and use the Portal (i) you have all rights necessary to upload the information to the Portal; (ii) the information uploaded by you may be shared with third parties; and (iii) the use of such information as contemplated under these Terms will not violate any law or any rights of any third party. The School disclaims any and all liability in connection with the information uploaded by you. You agree that you, and not the School, are entirely responsible for all of the information that is transmitted, uploaded or posted by, or stored in your account on the Portal. You assume all risks and liabilities associated with use of the information uploaded by you.
• You shall not display, upload, modify, publish, transmit, update or share any information which:
  
belongs to another person and to which you do not have any right;
  ‍
  Is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
  
  Is or promotes activities that are harmful, harassing, abusive, threatening, blasphemous, disparaging, defamatory, obscene, pornographic, paedophilic, defamatory, libellous, invasive of another’s privacy, hateful, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever;
  
  Is misleading in any way;
  
  Is offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;


  
  Harassing or advocates harassment of another person;


  
  Involves the transmission of “junk mail”, “chained letters”, or unsolicited mass mailing or “spamming” or similar activities;


  
  Infringes upon or violates any third party’s rights (including, but not limited to, intellectual property rights, rights of privacy or rights of publicity);

  
  promotes an illegal or unauthorized copy of another person’s copyrighted work;


  
  Provides instructional information about illegal activities such as making and/ or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;


  
  Solicits gambling or engages in any gambling activity which we in our sole discretion believe is or could be construed to be as illegal;
harms minors/children in any way;


  
  Violates any law for the time being in force;


  
  Impersonates another person;


  
  Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information; or


  
  Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.
• You acknowledge that the School is only an intermediary (as such term is defined under the Information Technology Act, 2000) with respect to your information. On receipt of a complaint from anyone that the information uploaded by you allegedly infringes the intellectual property rights of a third party, or violates the restrictions stated in these Terms, the School may remove or disable access to your information, with or without notice (prior to otherwise) to you.

7. Use Limitations

• Services offered on or through the Portal are intended solely for the purposes determined and approved by the School from time to time. You may not distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or otherwise utilize for monetary gain any information, software, products or Services offered by the Portal.
• As a condition of your use of the Portal, you warrant and undertake that you will not use the Portal for any purpose that is unlawful or prohibited by these Terms. You further undertake not to use the Portal in a manner which could damage, disable, overburden or impair the Services or interfere with any other person's use or enjoyment of the Portal. You further acknowledge that these terms and conditions shall apply to you regardless of whether your usage of the Services is for your benefit or for the benefit of any other person, and that under no circumstances shall the School be liable for any consequences of usage of these Services, whether to you or to any third party.
• You are not entitled to use any kind of measures, mechanisms or tools (software or hardware) that could interfere with the functioning of the Portal or any of its Services.
• You may not use the Services and/or Portal if you have been convicted of any offence under applicable law. For users of the Portal who are under the age of 18 years, the usage of the Portal either by your parents (or your guardian) or by you with the permission of your parents (or guardian) will be deemed as your acceptance of these Terms.
• You agree that you will not upload to the Portal any information that is contrary to these Terms, the privacy policy, or any other policy of the School as may be updated from time to time, or applicable laws and regulations. If any such information is uploaded to the Portal in any manner and for any reason whatsoever, you shall ensure that such information is deleted from the Portal immediately.

8. User Names and Passwords

• You may be required to register an account on the Portal in order to access certain Services.
• You must create only one account and ensure that any information provided by you is not misrepresentative or fake. You represent and warrant that any information provided by you is and will at all times be true, complete, correct, accurate, and not misleading in any way.
• You shall be responsible for maintaining the confidentiality of any password you use to access the Portal and you agree not to transfer or share such password or user name, or lend or otherwise transfer or make available use or access to the Portal to any third party. You agree to notify us of any unauthorized use of your password or user name or any other breach of security related to your account of which you become aware. You shall be fully responsible for all use of the Portal and any Services that occur in connection with your user name, except to the extent that any unauthorized use is not caused by any breach of your obligations of these Terms.
• We reserve the right to restrict or prohibit access to the Portal to you if you violate these Terms or our Privacy Policy.

9. General

• By using our Services you hereby agree to ensure that the explicit prohibitions mentioned in section 6.3 are at all times adhered to. The School may use and/ or develop advanced technologies to detect any misuse of our Services. The School reserves the right to use and/ or develop automated means and/ or systems to improve our ability to detect and/ or remove any prohibited conduct that may be in violation of the applicable law and/ or may harm the integrity of our Services.
• Use Restriction: You must not access the Portal if you are a person who is either barred or otherwise legally prohibited from receiving or using the Service(s) under any applicable law.
• Services may be made available free of cost or for a specified cost as may be decided by the School from time to time.
• Third-Party Fees: You may incur access or data fees from third parties (such as your internet provider or mobile carrier) in connection with your use of the Services and/ or Portal. You are solely responsible for the payment of all such fees.
• Updates: You may need to install updates to the Portal or related software that we introduce from time to time to use the Portal. Services originating from the Portal may communicate with the servers from time to time to check for available updates to the Services and to the functionality of the Portal, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, "Updates"). Your use of the Services installed by you may require you to agree to receive such automatically requested Updates.
• Accuracy of Information: You agree that the information entered by you while creating or updating your profile, or using any of Services is true, current, complete and accurate in all respects. The School is not responsible for any losses arising out of discrepancy in your data. You are solely responsible for maintaining confidentiality and security of your user account and for all activities that occur on or through your user account. The School is not responsible for any losses arising out of the unauthorized use of your user account.

10. Liability Disclaimer and Indemnity

IN NO EVENT SHALL ANY OF THE SCHOOL, ITS AFFILIATES AND/ OR THEIR RESPECTIVE DIRECTORS, OFFICERS, AGENTS, CO-BRANDERS, PARTNERS, CONSULTANTS AND EMPLOYEES BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF (A) THE USE OR DELAY IN USE OF, OR INABILITY TO USE OR ACCESS THE PORTAL OR THE SERVICES; (B) LOSS OF USE, DATA OR PROFITS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE PORTAL OR THE SERVICES; (C) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION OR SERVICES OBTAINED THROUGH THE PORTAL; OR (D) FOR ANY SECURITY BREACH OR ANY VIRUS, BUG, UNAUTHORIZED INTERVENTION, DEFECT, OR TECHNICAL MALFUNCTIONING OF THE PORTAL, IN EACH CASE WHETHER OR NOT FORESEEABLE OR WHETHER OR NOT THE SCHOOL, ITS AFFILIATES AND/ OR THEIR RESPECTIVE DIRECTORS, OFFICERS, AGENTS, CO-BRANDERS, PARTNERS, CONSULTANTS AND EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES, CLAIMS OR DAMAGES, OR BASED ON ANY THEORY OF LIABILITY, INCLUDING BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT, OF OR IN CONNECTION WITH, YOUR USE OF, OR ACCESS TO, THE PORTAL OR THE CONTENT. FURTHER, NONE OF THE SCHOOL, ITS AFFILIATES AND/ OR THEIR RESPECTIVE DIRECTORS, OFFICERS, AGENTS, CO-BRANDERS, PARTNERS, CONSULTANTS AND EMPLOYEES SHALL BE LIABLE TO YOU FOR ANY TEMPORARY DISABLEMENT, PERMANENT DISCONTINUANCE OR MODIFICATION OF THE PORTAL BY THE SCHOOL OR FOR ANY CONSEQUENCES RESULTING FROM SUCH ACTIONS.

YOU SHALL BE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ANY EQUIPMENT AND ANCILLARY SERVICES (INCLUDING THE PAYMENT OF ANY ADDITIONAL FEES THEREFORE) REQUIRED TO CONNECT TO, ACCESS OR OTHERWISE USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, VIDEO-ENABLED DEVICES, VIDEO COMMUNICATION SERVICES, MODEMS, HARDWARE, SERVERS, SOFTWARE, OPERATING SYSTEMS, NETWORKING, WEB SERVERS, INTERNET AND TELEPHONE SERVICE (COLLECTIVELY, “EQUIPMENT”). YOU WILL ALSO BE RESPONSIBLE FOR MAINTAINING THE SECURITY OF THE EQUIPMENT AND FOR ALL USES OF THE EQUIPMENT WITH OR WITHOUT YOUR KNOWLEDGE OR CONSENT.

YOU ARE SOLELY RESPONSIBLE FOR THE INFORMATION AND OTHER MATERIALS YOU TRANSMIT THROUGH THE PORTAL OR SHARE WITH OTHER USERS OR RECIPIENTS. YOU WILL NOT TRANSMIT ANY INFORMATION THAT YOU DID NOT CREATE OR THAT YOU DO NOT OWN ALL RIGHT, TITLE AND INTEREST IN AND TO, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHT AND RIGHTS OF PUBLICITY CONTAINED THEREIN OR THAT YOU DO NOT HAVE THE LEGAL RIGHT TO TRANSMIT, INCLUDING BY WAY OF A LICENSE.

NONE OF THE SCHOOL, OR ANY OF ITS AGENTS, REPRESENTATIVES, CONSULTANTS OR THIRD-PARTY SERVICE PROVIDERS MAKE ANY REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS OR ACCURACY OF THE INFORMATION, SOFTWARE, SERVICES AND RELATED CONTENT CONTAINED ON THE PORTAL FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE, SERVICES AND RELATED CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. EACH OF THE SCHOOL AND ITS REPRESENTATIVES, AGENTS, CONSULTANTS AND THIRD-PARTY SERVICE PROVIDERS HEREBY DISCLAIM, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS WITH REGARD TO SUCH INFORMATION, SOFTWARE, SERVICES AND RELATED CONTENT, INCLUDING ALL IMPLIED REPRESENTATIONS, WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

YOU SPECIFICALLY AGREE THAT THE SCHOOL SHALL NOT BE RESPONSIBLE FOR ANY UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO THROUGH THE PORTAL. YOU SPECIFICALLY AGREE THAT THE SCHOOL IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL SERVICES OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT THE SCHOOL NOT IS RESPONSIBLE FOR ANY SERVICES SENT USING AND/OR INCLUDED IN THE PORTAL BY ANY THIRD PARTY.

THE SCHOOL TAKES PROPER CARE AND PRECAUTIONS TO ENSURE THAT THE INFORMATION PROVIDED ON THIS PORTAL IS ACCURATE. HOWEVER, THE SCHOOL CAN NEITHER GUARANTEE NOR DOES IT ACCEPT ANY LIABILITY ARISING FROM OR CONNECTED TO, THE ACCURACY, RELIABILITY, CURRENCY OR COMPLETENESS OF ANYTHING CONTAINED ON THE PORTAL OR ON ANY LINKED SITE.

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS EACH OF THE SCHOOL, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, SUBSIDIARIES, OFFICERS, AGENTS, CO-BRANDERS, PARTNERS, CONSULTANTS AND EMPLOYEES HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITY, DAMAGES, COSTS OR DEMANDS, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR SUBMISSONS, YOUR USE OF THE WEBSITE/PORTAL, YOUR CONDUCT IN CONNECTION TO THE WEBSITE, YOUR VIOLATION OF THE TERMS OF USE OR ANY APPLICABLE LAW, OR YOUR VIOLATION OF ANY RIGHTS OF ANOTHER PERSON/ENTITY, INCLUDING INFRINGEMENT OF THEIR INTELLECTUAL PROPERTY RIGHTS.
